On Nov. 19, the United Property Owners of Montana (UPOM) filed a notice of appeal with the high court regarding its lawsuit against the state Department of Fish, Wildlife & Parks and the Fish and Wildlife Commission over elk management. In the notice, the group challenged the final judgement and “all previous orders, rulings, and decisions excepted or objected which led up to and resulted in the Final Judgement.” An FWP spokesman refused to comment on ongoing litigation as did the agency’s attorney. “We feel the district court judge did not address the key question of whether the law requires FWP to manage big game populations to objective levels, and to use every tool available to do so,” said Chuck Denowh, policy director for UPOM. “We’re confident that the Supreme Court will answer this question, and provide the need of relief to the Montana landowners who are suffering from FWP‘s inaction.” A landowners' group is appealing a District Court judge's ruling in a lawsuit over the state's management of elk. Judge’s ruling UPOM is a nonprofit that touts ties to ranchers, landowners and outfitters. The group sued FWP and the commission in 2022 to compel the agency to “remove, harvest, or eliminate thousands of elk this year” citing damages that caused “an economic crisis” for its members. In September, Tenth Judicial District Court Judge Gregory Todd ruled FWP and the commission had “considered the concerns of private landowners” and were managing for a “sustainable elk population,” the Montana Free Press reported. Judge Todd shot down UPOM’s request seeking to require FWP to reduce elk populations, saying Montana statutes “do not provide the ‘clear legal duty’ to cull elk herds to UPOM’s objectives.” “The obligation of FWP and the Commission is not to kill thousands of elk, but rather to manage their objectives,” Todd wrote . “The standard is to use discretion to facilitate reducing and maintaining elk at their objective levels. If the State had no discretion, there would be no need for an elk management plan.” Denowh disagreed. “We’ve asked that FWP use every tool available to bring elk populations down to a reasonable level,” he said. “They’ve refused to do so, resulting in our lawsuit and now this appeal to the Montana Supreme Court.” Intervening Seven Montana sporting groups and public access advocates successfully petitioned the court to intervene in the lawsuit, which UPOM has also challenged. Frank Szollosi, executive director of the intervening Montana Wildlife Federation, said the groups are willing to do whatever it takes to defend science-driven, equitable elk management and licensing. He admitted some landowners experience game damage as elk populations have grown, but disagrees with UPOM’s suggestions for reducing elk numbers. Szollosi said his group has worked with agricultural producers in the past to find solutions and will continue to do so. Yet Denowh said, “Central Montana landowners are being asked to shoulder an inordinate burden with big game populations that are far in excess of the target populations set by FWP. It’s costing them millions in lost feed and forage every year.” Elk divide The largest population of elk in central Montana is in Hunting Districts 411 and 535, next to the Big Snowy Mountains, where large landowners control access to a herd that numbered around 10,300 in 2023, within FWP’s management goals. Wildlife such as deer and elk on such properties are touted as selling points for ranches when they are listed, boosting a property’s price especially if access is exclusive. Meanwhile, outfitters sell trophy bull elk hunts for $6,000 to $12,500 each on lands where they claim exclusive access. Killing cow elk is the recognized way to reduce elk populations, since they produce offspring. However, outfitting for cow elk doesn’t generate the same amount of revenue. More recently, FWP has identified chronic wasting disease (CWD) infecting individual elk across the state. The always fatal disease is spread by contact with an infected animal’s bodily fluids. Agricultural fields where elk congregate are more likely to see the disease spread. Emily Mitchell, an FWP biologist, said CWD may be more prevalent in the state’s elk population than known since so few animals have been tested. There is no test for the disease in live animals. “I think we have such a small sample size of elk that it isn't that it's new on the landscape, we just hadn't gotten enough samples to detect it yet,” Mitchell said last month. Wildlife In 2024, Montana estimated the state’s elk population at 145,000, an increase of about 1.700 from the previous year. The state’s population goal is between 96,000 to 151,400. Thirty hunting districts, out of 138 were over FWP’s population goals, which are set based on landowner tolerance. Region 3, in southwest Montana, has the largest concentration of elk in the state, estimated at about 54,600 animals in 2023. One of the biggest herds in the state is in Region 3’s Gravelly Mountains, last estimated at more than 8,500 animals. In a Western Landowners Alliance article published last May, Granger Ranch operations manager Billy Whitehurst estimated the costs of feeding about 600 elk during the 2021-22 winter on the Region 3 ranch at $32,400 in lost crop productivity. Politics UPOM’s appeal comes as Cory Swanson is waiting in the wings to be sworn in as the new Montana Supreme Court chief justice. Denowh’s political lobbying company, The Montana Group, was one of the largest contributors to Swanson’s campaign. Swanson has worked as the Broadwater County attorney since 2014. Gov. Greg Gianforte also appointed a new director to lead FWP, Christy Clark, who has been the director of the state Department of Agriculture. Clark’s family ranches in the Choteau area where she also served as a Republican legislator for three terms. In the 2021 session, Republican legislators attempted to weigh in to the elk dispute with proposals to give landowners more freedom in providing hunting tags to people of their choice and may seek to again this session, Szollosi worried. It’s a digital cash card that’s built into Apple devices and can be found in the default Wallet app. (Note: You must link an eligible debit card to use this service.) The main function of Apple Cash is to make it easier for Apple device users to send money to one another, including sending money through the iMessage app. But Apple Cash is more than just a peer-to-peer (P2P) payment service — it can be used to shop online, in stores or to make in-app purchases. Apple Cash is a convenient way to transfer money between friends and family. Once it’s set up, a user can simply open the iMessage app and send money to a contact through their chat. It’s also useful for those who use Apple Pay, a separate service that allows Apple device users to make contactless payments with any linked card, including an Apple Cash card. Here are some important things to know about setting up and using Apple Cash. Apple Cash is a digital cash card that’s stored in the Wallet app of Apple devices, and it can be used for making P2P payments, as well as purchases through Apple Pay. When you receive money from another Apple Cash user, that money appears in your Apple Cash balance. The balance can then be spent or transferred to a linked bank account or debit card. Sending money to peers with Apple Cash can be done either directly from the digital Apple Cash card (in the Wallet app) or through the iMessage app. You can send or receive anywhere between $1 and $10,000 per message. The money shows up on the recipient’s Apple Cash card instantly, but it may take from one to three days for the balance to be transferred to a bank account. Instant transfers to a bank account are possible, but it comes with a 1.5% fee. There’s also an option to set up Apple Cash Family for children who are under 18 years old. This option limits the amount a child can send to $2,000 per message. Those younger than 18 also cannot add money to their Apple Cash card from a bank account; rather, their balance only grows when they receive money from another Apple Cash user. Apple Cash is a digital card within your Wallet that allows you to spend your Apple Cash online, in stores and in apps as well send and receive money. Apple Pay, however, allows you to make purchases using any credit card or debit card you have stored in your Wallet — including Apple Cash. With Apple Pay, you add credit and debit cards to your Wallet and then have the ability to pay right with your phone (or other Apple product). To set up Apple Cash, you’ll need three things: —A compatible Apple device. —Two-factor authentication enabled for your Apple ID (this can be done in Settings). —An eligible debit card to load funds onto the Apple Cash card. In the Settings app, you can turn on Apple Cash in the Wallet and Apple Pay section. Tap on the Apple Cash card icon and follow the instructions on the screen. You’ll be asked to agree to the terms and conditions, after which your device will set up Apple Cash for you. The Apple Cash card, once set up, can be found in your device’s Wallet app. If you want to set up Apple Cash Family, you’ll first need to have Family Sharing turned on, which can be done in Settings. The family organizer can add children to Apple Cash in the Family Sharing section of Settings. You’ll need to have a debit card linked to your digital Wallet to add money to an Apple Cash card. You can add a debit card to Wallet in the same place where you set up Apple Cash — the Wallet and Apple Pay section of Settings. Once a debit card is linked to your Wallet, open Wallet and tap on the Apple Cash card. Then, tap the More button (an icon with three dots). This will open a page where you can see your Apple Cash balance, add money and transfer funds to a bank account. Tap Add Money and enter the amount you’d like to add (the minimum is $10). You’ll be asked to confirm which debit card you want to use to fund the Apple Cash balance, and then the money is added to the Apple Cash card. There are two ways to send a payment to someone using Apple Cash: directly from your Wallet or in the iMessage app. Both the sender and recipient need Apple Cash to send or receive money. To send money from Wallet, simply tap the Apple Cash card in Wallet and then tap Send. Type in the contact name or phone number of the recipient. Enter the amount you’d like to send (between $1 and $10,000), then review the payment and confirm it with Face ID, Touch ID or a passcode. In iMessage, open the conversation with who you’d like to send money to, or start a new one. Tap on the app button, which appears next to the type bar, and then tap on the Apple Cash icon. You’ll be prompted to enter an amount (between $1 and $10,000). Once you’ve reviewed the amount, tap Send and confirm with Face ID, Touch ID or a passcode. The first time money is sent to someone, the recipient will need to accept the payment within seven days for it to go through. After the first instance, payments are automatically accepted. If you’re using Apple Cash to make a purchase either online or in a store, you’ll need to pay using Apple Pay. To request money from your iPhone, open the conversation in the Messages app. Tap the plus icon, followed by Apple Cash. Then, tap Request. Tap the send button to send your payment request. Once the request is sent, the person you sent it to can confirm or change the amount they send to you. You can also request money from your Apple watch. Open your messages app, choose a conversation, tap the plus icon and then choose Apple Cash. Once you enter the amount you are requesting, swipe left on the Send button. Tap Request. As you start to accumulate money on the Apple Cash card, you may want to move it to a debit card or a bank account . This can be done by going to the same place where you added funds to the card, by clicking the icon with three dots next to your digital card. Enter an amount to be transferred, then tap Next. You’ll be asked whether you want to do an instant transfer (for a 1.5% fee) or a transfer in one to three business days for free. After making a selection, the screen will instruct you to set up a bank account if you don’t already have one set up. You’ll confirm the payment, and the transfer is initiated. Instant transfers can only be made to an eligible debit card, not a bank account. Ole Miss ' 24-17 loss to Florida continues a familiar storyline that has plagued even its best seasons in the modern era. The Rebels have never played in the SEC Championship Game -- which began in 1992 -- and must go all the way back to 1963 to find their last conference title. Great players and coaches have come through Oxford, delivering huge moments and big wins, but over the course of a season, the Rebels have too often struggled to string together enough successful moments to propel them into SEC title contention. The last time Ole Miss was on the field, a record crowd of 68,126 stormed a rain-soaked field after the Rebels downed Georgia 28-10. The Bulldogs were the highest-ranked visiting team to lose in Vaught-Hemingway Stadium, and the College Football Playoff implications were clear in the wake of the win. Tiebreaker scenarios weren't favorable to Ole Miss in terms of making the SEC title game, but with a head-to-head win against Georgia, the Rebels were well-positioned to compete for an at-large spot in the 12-team playoff bracket -- as long as they finished the season 10-2. With Florida and Mississippi State on the schedule for the final two games, Ole Miss spent part of the off-week thinking about the future. Lane Kiffin discussed the potential advantages of not playing in the SEC Championship Game, and fans took to social media to argue for playoff inclusion, and even a top-8 seed that could bring a home-field playoff game in the first round. Instead, Ole Miss let history rear its ugly head Saturday. The loss to the Gators eliminates the Rebels from SEC title contention again and potentially cost them a shot at the College Football Playoff. Those comments about the SEC Championship Game came from a coach speaking to other coaches concerned about what a third loss would do to a team's playoff profile. But context will be lost, because fans will remember only that Lane Kiffin was discussing how it might be better not to play in the title game -- just before a devastating loss that crushed their playoff hopes. While the locker room is a wide-ranging collection of backgrounds and personalities, it's Kiffin who has pulled them together and kept the program moving in a winning direction year after year. But Saturday's loss will sting for Kiffin, who had a chance to follow up the Georgia win with a College Football Playoff run. With multiple New Year's Six appearances, Kiffin's Ole Miss program was among those most expected to benefit from an expanded playoff field. The Rebels could have made the CFP in previous years under this year's format, and with the Georgia win in the bag, all Kiffin needed to do was land the plane. While the game itself lacked the drama of others, it brought back memories of Ole Miss facing Arkansas in 2015. After an early season win against Alabama and victories against division foes Texas A&M and Auburn , the Rebels needed only to hold serve for a trip to the SEC title game. They had the Razorbacks seemingly stopped on a 4th-and-25 in overtime until Hunter Henry's baffling one-handed lateral over his head was picked up off the bounce by Alex Collins and advanced for a first down. Florida twice crushing Ole Miss' lofty hopes carries some poetic intrigue. It was the Rebels who upset the Gators in 2008, prompting Tim Tebow's famous "promise" after the game. Tebow followed through on his word and delivered the Gators a second national title in three years. With Florida's win on Saturday, the Gators are now 3-0 against Ole Miss since "the promise". WASHINGTON -- When President Joe Biden visited Angola last week, one of the highlights was his pledge of hundreds of millions of dollars for an ambitious trans-Africa rail project that would bring copper and cobalt from central Africa to the Atlantic port of Lobito. The project is possible because of the commitment of a $553 million direct loan from the U.S. International Development Finance Corporation, created in 2019 during the first Trump administration to counter China's expansion of its global reach through infrastructure projects, such as the mega-port in Chancay , Peru, inaugurated just last month. On Monday, the U.S. agency celebrated its five-year milestone by vowing to advance U.S. foreign policy and strategic interests through projects around the world such as the one in Angola. It also seeks re-authorization from Congress and a greater ability to invest in more countries when there's a strategic need to compete with China. “We need to be good partners while offering an alternative based on our values," said Scott Nathan, the chief executive officer of the development agency, who was in Angola last week with the president. “Quite simply, we need to continue to show up.” Nathan is set to leave the post. President-elect Donald Trump is yet to name his pick to lead the agency. Over its first five years, the agency has developed a portfolio of more than $50 billion in 114 countries, including solar panel manufacturing in India, a power plant in Sierra Leone, and digital infrastructure in South America. To do that, the agency has leveraged government funding to partner with private investments. In the last fiscal year, the agency committed to $12 billion in new transactions, using the roughly $800 million in appropriations, Nathan said. Investments by the agency are having a “transformational impact on economic development while concretely advancing U.S. strategic interests,” Nathan said. In Angola, for example, the rail project would help secure the supply chain by cutting both time and cost in transporting critical minerals. National security adviser Jake Sullivan said the agency was created when the U.S. was “ceding the field" to China in a new era of geopolitics.
